Category C (minor Impact) Issues – Ballot #5-08
This proposal includes three changes to the NACHA Operating Rules (Rules) that would have minor impacts on the ACH Network. This proposal also includes two changes to the NACHA Operating Rules (Rules) that are editorial in nature and would have no impact on the ACH Network or its participants. These proposed modifications are grouped into one ballot based on their proposed implementation date of December 19, 2008.
Minor impact issues:
· Modify sections in Appendix Eleven (Rules Enforcement) to address the parties allowed to submit rules violations.
· Modify Article Five (Obligations of Third-Party Senders) to explicitly state that ODFIs are responsible for their Third-Party Senders (TPS), and close gaps of coverage under the Rules in a Third-Party Sender relationship.
· Modify Article Two, Subsection 2.5.1 to refine the definition of “erroneous entry” as it relates to reversals.
Issues with no impact to participants:
· Revises Article One, Section 1.9 (Beneficiaries of the Rules) to include Associations within the list of intended beneficiaries of the rules.
· Revises Article Two, Section 2.12.1 (General Rule) and Article Three, Subsection 3.9.2 (Source Documents) to incorporate source documents provided at a manned bill payment location within the discussion of POP entries.
